Analysis Of The Legal Status Of Industry-university-research Cooperation

The article analyzes the key factors that hinder the development of IURC(industry-university-research cooperation)in China from the legal angle,and proposes to improve relevant legal systems to promote the development of IURC.Firstly,through analyzing the Fu Lin's case,it is pointed out that the current imperfection of the legal system restricts the development of IURC in China.Secondly,combing the current IURC legal system in China and analyzing the necessity of perfecting relevant legal systems.Again,the legal status quo of IURC in China is summarized in terms of achievements and existing problems.The main problems are: IURC does not establish a sound legal system guarantee;the investment of scientific research funds and management are unreasonable;the personnel training policy is not in place;the law of scientific research equipment sharing is not perfect;the intellectual property right is not clearly defined and the protection is far from being sufficient;there are gaps in related laws such as intermediaries;the legal awareness of the main body of IURC is weak.Finally,in order to promote the development of domestic IURC,we should refer to effective legal means in other countries to promote domestic IURC,and formulate basic laws that mainly focus on the fields of IURC;Moreover,we should improve the relevant legal systems from the angle of following: increasing the investment and management on IURC funds,talent training,formulating special scientific research equipment sharing law,strengthening intellectual property legislation and protection and legal awareness of the main body of IURC,legislating to support intermediary agencies.
