On The Legal Regulation Of The Police Administrative Investigation Power In China

Compared with other administrative powers,the administrative investigative power of the police is more likely to have a negative impact on the administrative counterpart,whether from the scope or in the way of the exercise.The emergence of "Lei Yang incident" raises a practical problem,that is,we must regulate the police administrative investigation power.Based on the connotation of the police administrative investigation power,this thesis analyzes the difference among police administrative investigation power,police administrative procuratorial power and police criminal detective power.From the operation of the police administrative investigation power,there are some problems in it,such as the imperfect legislative system,the abuse of the power,the violation of the procedure of violating the power and the imperfect supervision system.In the process of legal regulation of police administrative investigation power,we should follow the principles of rule by law,administrative openness and proportionality.At the same time,we should improve relevant legislation,strengthen the internal supervision and external supervision system of police organs,and improve the procedure of police administrative investigation.Only by perfecting the legal regulation of police administrative investigation power,can we better protect citizens' legitimate rights.
