In recent years,with the rapid growth of Chinese couples,the divorce rate has been increasing year by year.China’s marriage law stipulates two procedures for divorce and divorce proceedings.In judicial practice,both husband and wife should take the divorce procedure to dissolve the marriage relationship,there may be the property dispute after divorce.Property dispute after divorce since 2008,when China was identified after level3 cause of action for civil cases,the court accepted a lot of divorce property disputes,but because of the relative lack of legislation in our country,in the judicial practice after the divorce property disputes exist different degree of connection,seriously affected the judicial credibility.Accepted by taking a city then three years after the divorce property disputes as the research basis,through the analysis of current status of the judicial relief after the divorce property disputes,dilemma,explore the shortage of legislation,and then from consummates our country marriage family legislation and theoretical research of marriage and family system top level design for the Angle of view,put forward the judicial response.
