Civil Law Protection Of Personal Information Rights

The 111 th article of the general principles of Civil Law stipulates the protection of personal information and provides a direction for the establishment of personal information right.In recent years,the citizen's personal information right has been infringed,has produced the extremely bad social influence.This article starts from the real case,probes into the problems of judicial practice caused by the lack of personal information right,and points out the personal information right and other similar civil rights by taking the concept,characteristic and the attribute of the personal information right as the starting point.While discussing the interests contradiction in the personal information circulation activities,the paper excavates the interests pursuit and status comparison of the parties behind the personal information circulation.In addition,this paper analyzes three kinds of personal information protection modes of decentralized protection mode,unified protection mode and compromise protection mode,and tries to provide reference for the civil protection of individual information right in our country.The article proposes to establish the personal information right as an independent personality right in civil law,and comprehensively protects the personal information right in the future civil legislation work by perfecting its content and constructing the personal information protection system.
