Research On The Main Body Status Of Economic Law Of Procuratorial Organs In Public Interest Litigation

In the case of infringement of the illegal interests of the state and the public interest,the procuratorial organs as procuratorial organs with the functions of public interest litigation on behalf of the state public authorities have become increasingly prominent in the field of economic law.From the perspective of economic law From the perspective of subjective position,this paper systematically analyzes the dominant position of procuratorial organs in the public interest litigation.The main purpose of this study is to comprehensively analyze the main position of the procuratorial organs in economic law.The article is mainly divided into four parts to be discussed in detail:The first chapter separately discusses the main body of economic law and the subject of economic law.Through the comparison of the two,it concludes that the subject of economic law belongs to the main body of economic law.The second chapter discusses the main position of procuratorial organ's economic law in public interest lawsuit.Through the definition of public interest litigation,public interest protection and prosecutorial function,the main position of procuratorate in public interest litigation,the procuratorial body in public interest litigation The connotation of the main status of economic law and the scope of the case were analyzed comprehensively.The third chapter focuses on the legitimacy of the main body of the economic law in the public interest litigation from three aspects:the legal policy basis of the procuratorial organ's status in the public interest litigation,the necessity and feasibility of the procuratorial organ's status function in the economic law.The fourth chapter analyzes the obstacles that the prosecutorial agencies play in the public service lawsuit,and puts forward some effective measures.
