Research On The Legal Issues Of The Basic Duties Of Trade Unions

China labor unions are mass organizations of the working class,it’s formed on a voluntary basis by under leadership by the Communist Party of China.China labor unions serves as bridge and tie to connect Party with employees.Under leadership of CPC,China labor unions mobilize and organize workers and employees to take an active part in revolution,economic construction and reform.One of labor union’s basic responsibilities is protecting workers’ legal benefits,which came into force after Labor Union Law was revised.Its duties and functions cater to the development of labor relations in market economy,also show solicitude for disadvantaged groups in society and protections for labors’ human rights.However,in reality there are many cases workers take aggressive actions to protect their rights,which means that there is still room for Labor Union of China to make satisfying results and contradictions between written laws and how laws actually work in fact.This thesis finishes in the order of finding out legal questions,introducing foreign experiences and providing legal suggestions.In details,this article first explains the responsibilities of Labor Union of China and their supporting theories-Community Organizations,institutional economics and labor relations.Second,this article analyzes responsibilities of Labor Union of China and makes conclusions that major problems are that lack of labor rights protection,failure of labor union’s right of representation and low level of organizations’ autonomy.Then,the forth part does research about foreign experiences.Labor union of United States of America,Germany and Japan all have their own specialties.For China,there are some aspects to learn,therefor,this article introduces labor unions’ legal detailed responsibilities of these countries.In the last,this article makes some legal suggestions to complete labor union’s right of representation,protections for labor rights and methods to take effective actions.Due to globalization,it is common that enterprises are becoming strong but labor rights are neglected worldwide.In China,working class is leading group,problems about working class play a significant role in labor relations and even society’s economy.There for,it is important to perfect labor union’s system.Based on this idea,this article starts from labor union’s duties and does research to bring out some legal suggestions.
