In recent years,with the rapid development of Internet technology and the popularization of the "Internet + Charity" model,individuals have gradually increased their requests for funds through the Internet.In particular,they have raised funds for the public based on the lack of medical treatment for major diseases.The "Internet +charity" model has diversified the mode of charity and promoted the reform of traditional charity.Furthermore,it has promoted the vigorous development of charity in our country.However,as a new mode of charity,due to the immaturity of its own development,as well as the laws,regulations,there is not a certain standardization,there are many hidden problems in practice.In March 2016,China enacted "Charity Law of the People's Republic of China",which legitimized the fund raising activities of Non-profit organization.This is not only a clear legal status for charity activities in the charity area of our country,but also detailed regulations.Personal internet fund raising with the mode of "Internet +" combination is a product of the age of Internet.As for now,there is no law dealing with personal online fund-raising,including the Charity Law of the People's Republic of China,which creates a legal gap in personal online fund-raising.No matter from theory or practice,the industry has not formed a standardized process,and each online platform for fund raising has their own rules;and the legitimate rights and interests of the parties concerned cannot be guaranteed;and the legal relationship between the parties need to be explored.Personal online fund raising is a personal help-seeking behavior,but also belong to a kind of social assistance.This article attempts to explore a number of legal issues regarding the existence of "personal online fund raising." First of all,it will organize the current online platform for fund raising,secondly put forward the legal problems existing in cases,and then discuss the legal relationship and the content of rights and obligations.Finally,it will put forward some advice improving the legal system.
