On The Russian Civil Security System

Civil protection is a judicial coercive measure to ensure the effective implementation of civil judicial decisions.The main legal sources of Russian civil protection are the "Russian Federation Civil Procedure Code" and the "Russian Federation Arbitration Procedure Code",including two important ways of pre-trial preservation and litigation preservation.Due to the strong ideology of the authoritarianism and adopting the legislative principle of “should not be appropriate”,Russia's civil protection legislation is too general and operability is not strong enough to lag behind the needs of social development and cannot effectively guarantee the smooth implementation of judicial rulings.Because the legislative model of China's civil litigation system was deeply affected by the Soviet legal system in the 1950 s,the problems existing in the Russian civil protection system will also exist in our civil protection system more or less.In addition,there are some experiences in Russia's civil protection system regarding acceptance examination,relief measures,and cancellation of rulings on protection.Taking its essence and discarding its dross,the article aims to improve China's civil protection system,and based on a comprehensive analysis of the Russian civil protection system,it changes the duration and scope of property preservation,limits the discretion of judges,and increases preservation measures.The specific suggestions for improving China's civil protection system have been put forward in terms of increasing the means of relief and renewing legislation in a timely manner to meet social needs.
