Use Alipay To Defraud Property Crime Research

In recent years,with the continuous development of China's science and technology,the Internet has become more and more widely used in our lives.Various electronic products derived from the Internet are quietly changing our lives.Alipay,as an "outstanding" representative of Internet derivatives,has been favored by many people since its emergence.However,while Alipay has brought a lot of convenience to our lives,it has also brought a variety of security risks.The most typical of these is the use of Alipay for criminal activities to obtain property,which has brought extremes to our traditional criminal law.In fact,in terms of the nature of the behavior,the property-related commitment of Alipay is the same as other new types of Internet crimes,which all change the forms of crime.However,the use of Alipay for property crimes combined virtual property with digital products,and the criminal means often present complexity and highly concealed features,which made it difficult for us to carry out the crime on the basis of traditional property crimes alone.At the same time,it has also arose discussions on the determination of the nature of property crimes in all fields of life.The article discusses how to identify the behavior of acquiring property through Alipay.There are three charges involved,namely,theft crime,fraud crime,and credit card fraud crime.The following questions are mainly discussed: Alipay's qualitative questions,whether Alipay can be a target of fraud,whether the conduct of the case constitutes a triangle fraud,and how the crime of theft and fraud delimits.In view of the aforementioned problems,the article has conducted an in-depth research and concluded that with the continuous development of science and technology,Alipay as a "robot" with the function of recognition and ability of replacing the human brain to conduct business,may in some respects be the object of fraud.Therefore,in judicial practices,Alipay should be regarded as a new type of payment method closely related to credit cards,and whether or not an actor directly uses another person's credit card information in the process of committing a financial misuse,the action should be regarded as credit card fraud crime.
