Order to ensure the smooth operation of the investigation activities,fully respect and safeguard human rights,in March 2012,the 11 th National People's Congress of the criminal procedure law of the People's Republic of China on the second amendment,residential surveillance will specify dwelling into the residential surveillance system,so that the system of criminal coercive measures of our country tend to be more complete.However,in the process of the specific applicable effect has not expected at the beginning of the system design,mainly reflected in the designated home residential surveillance is not specific,the relevant provisions of the applicable in various legislative and practical problems,these problems easily lead to appear in is not the law behavior,damage the legitimate rights and interests of the person subjected to execution.Therefore,it is very important to further improve the study on residential surveillance.From four aspects in this paper analyze the designated home residential surveillance,first of all,analysis of designated home residential surveillance law overview,from his home to specify to residential surveillance and set out for understanding,further analysis of residential surveillance and the related measures specified dwelling;Secondly,the paper analyzes the legislative dilemma and the real dilemma that is encountered during the application process.The third is to explore the causes of the dilemma.Fourthly,from how to solve the residential surveillance,how to further improve the housing surveillance system.Future residential surveillance will also specify dwelling is controversial and implementation difficulties,but I believe with the deep research in the system,and the practice exploration,the system will be toward the more perfect direction.
