Research On The Compliance Of China's New Energy Automobile Industry Subsidy Policy Under The WTO Framework

States' subsidies have positive influence on relevant industries' development and national economic strength,but unjustified government's subsidies under the economic globalization will cause adverse effects on other nations and the whole international market.Thus,WTO rules make restrictions on subsidies to protect nations' basic economic benefits.Facing with the huge energy stress and pollution problem,China has been pursuing the development of new energy vehicles,which can't be pushed without the help of government's subsidies.These subsidies may be considered unjustified under SCM Agreement,leading to countervailing measures and charges from other member states.So it's very important to make an analysis on the legal identification of our government's subsidies on new energy vehicles,and try to figure out any solutions for improvement of government's policy on subsidies and making arguments in WTO cases.This article will first make an illusion on the background,main content and significance of our government's subsidies on new energy vehicle.Then it will make a legal analysis on the justification of aforementioned subsidies under WTO rules.At the end of this article,it will try to point out some proposals for amending government's subsidies policies and presenting our arguments before DSU.Besides,it will stress on and analyze on the possibility of applying general exception clauses in SCM Agreement for the justification of new energy vehicles.
