And almost at the same time,a major political reform that is rapidly advancing-the establishment of the state supervisory committee to achieve a severe blow to bribery and bribery crimes by more rigorous system construction;the twenty-second first and second paragraphs of the People's Republic of China supervision law,adopted by the thirteen National People's Congress in a meeting of the National People's Congress.The lien system for bribes and bribes is stipulated separately,which makes it more and more difficult to escape the crime of bribery or bribery discovered or revealed.However,from the social effect after the promulgation and implementation of the criminal law amendment(nine),the new penalty stipulation did not achieve the deterrent effect and the preventive effect on the bribe behavior at first.Experts and scholars put forward suggestions from the perspective of improving the criminal law legislation and the creation of non penalty penalties.Scholars from the legislative perspective think that some of the unreasonable provisions in the entry of the current crime of bribery should be amended,such as the abolition of "unfair interests",the abolition of the normative constraints of "money" and the change of the penalty penalty.The scholars who study from the perspective of non penalty punishment think that the aggravation or mitigation of the punishment of bribery does not effectively prevent the emergence of bribery,and should establish non penalty measures,such as establishing and perfecting the registration system of the case of briber file,and establishing the special bribe person.Voluntary surrender system and so on.We believe that,whether it is to amend the unreasonable provisions of the current criminal law,or to establish a series of non penal punishment systems,or the provisions of the lien on the suspected bribe offenders in the People's Republic of China supervision law,only one effect can be achieved,that is,to improve the investigation and punishment of bribery crimes already mastered by the investigative organs.And the intensity of the crackdown is not helpful to the exposure of bribery crimes that the investigation department has not grasped.We know that,because of the secret and strong characteristics of bribery crime,the number of crimes that the investigation department does not know is not a decimal number.How to start from the system level,improve the investigation rate of bribery crime that the investigation department has not grasped,and enhance the ability to prevent and control bribe crime,is the purpose of this study.Through the study,we find that in order to improve the investigation and punishment of bribery crime that the investigation department has not yet mastered,we must start with the basic system of social management,such as perfecting the system of cash management,property publicity,civil society credit,real estate registration,information disclosure and so on.Since the eighteen major,the central government's power list system and the public measures for the government approval flow chart have provided a model for the transparency of the government's power operation and the reduction of the space for the operation of the dark box.These also naturally compress the space for the implementation of bribe bribery crimes,and to a certain extent prevent the occurrence of bribery crimes.However,some other basic social management systems do not work well,for example,the cash management system in our country has a large gap compared with some western countries such as the United States,which is not conducive to the inhibition of the occurrence of bribery crime.This study will start with the cash management system and analyze the important effect of the basic social management system on preventing bribery.
