On The Objective New Types And Prevention Of Current Bribery Crimes

After China's reform and opening up,with the development of economy and society,the bribery crime presents some new characteristics,and bribery methods,more subtle,more and more complex,the objective of new type of bribery crime,put forward the new challenge to the current anti-corruption work.This article firstly makes a combing of the constitution of the crime of taking bribes and the legislation of taking bribes in our country,and puts forward the problems existing in the system construction and judicial practice of the cognizance of the crime of accepting bribes at the present stage.After the combination of typical cases,this paper analyzes the definition and characteristics of ten objective new types of bribery transactions,such as transactional bribery,stock-based bribery,cooperative investment bribery and entrusted wealth management bribery,as well as the difficulties and problems in judicial identification.Finally,this article put forward my own suggestions on how to better identify the objective new types of bribery crimes,including: strengthening the openness of the life of state workers;improving the supervision mechanism,giving play to the supervision role of financial institutions and implementing the reporting reward system Improve the legislative framework of the crime of accepting bribes,unify the criteria for the determination of the amount of cases involved,timely bring the "emotional investment behavior" into sin,expand the scope of the "bribe" method,improve the types and charges of penalties for accepting bribes,Crack down on bribery crime and so on.We hope these suggestions can do our best for the anti-corruption work in our country.
