With the rapid development of 3D printing technology,the arrival of the “socialized manufacturing” era is only a matter of time.However,when its low cost and high efficiency bring great benefits and convenience to people's production and life,the new challenges to the existing patent system comes too.This article starts from the subjects in the 3D printing process and discusses whether the behavior of various subjects involves patent indirect infringement.In view of the fact that China has no systematic system of patent indirect infringement in the field of patent law,this article will draw opinions and suggestions on the establishment of a patent indirect infringement system under the background of 3D printing,which based on the indirect infringement of US patents.This article is divided into four parts to discuss:The first part expounds the problems of direct patent infringement,indirect patent infringement and the relationship between the two,and explains the reasons for the indirect infringement of 3D printing patents.The second part discusses the behavior and characteristics of relevant subjects in the 3D printing process,and whether it constitutes a patent infringement or patent indirect infringement.The third part mainly analyzes the stipulations of the United States on the issue of indirect patent infringement.At the same time,it analyzes the deficiencies of China's relevant theories in the context of 3D printing.The fourth part is the main part of this paper.It mainly discusses the response of China's patent indirect infringement under the background of 3D printing,that is,what kind of position China should adopt for indirect patent infringement,and should be adopted to construct and improve the indirect patent infringement system with Chinese characteristics.
