The emergence of labor dispatch system has changed the traditional way of employment.Under the condition of socialist market economy,the labor dispatch system develops vigorously.The emergence of labor dispatch employment mode not only provides convenience for enterprises,but also provides a new road for the personnel system reform of public institutions.However,labor dispatch employment brings positive significance,but also there are some problems.Labor dispatch has three parties,this employment mode impact on the traditional labor legal relationship.Labor dispatch employment there are many problems,public service workers dispatched workers rights violations have been the phenomenon of labor rights and the reform of public institutions cause damage.Through the institution of labor dispatch employment problems analysis,to come to the solution.Rich labor dispatch workers rights and interests theory,make the labor dispatch system obtains the better development in the public institution.On the one hand is to improve the institution of employment system,on the other hand is to protect the rights and interests of labor dispatch workers.Institution is different from the enterprise,has its own particularity.As a product of the planned economy era,it is easy for labor dispatching employment to cause many problems in the modern market economy.In practice,most of the researches on labor dispatching system are from the perspective of enterprises,and there are few researches on dispatching institution.On the dispatch and the relevant institutions to sort out the theory of institutions,and thus the formation of a preliminary understanding of public institutions and labor dispatch.Analysis of institutions to send labor employment background,recalled the dispatch of labor and institutions to send labor regulations,to understand the status of institutions to send labor employment.So as to carry out research on the protection of the rights and interests of dispatched workers.The author points out that there are two major problems in dispatching labor service,the lack of labor dispatching legislation and the damage of labor rights.Lack of labor dispatch legislation led to the lack of legal restrictions on the dispatch of public service units,which is prone to abuse of labor dispatch workers.Difficult to send workers rights.The rights of equal pay for equalwork can not be guaranteed.Dispatch workers in the political,economic status and social identity there are differences.Collective rights and the treatment of industrial injury insurance.In order to solve the problem of safeguarding the rights and interests of dispatched workers in public institutions,it is necessary to clearly stipulate the legal relations.The determination of the subject of rights and obligations requires a clear legal relationship.By drawing lessons from the experience of foreign legislation,to solve the problem of safeguarding the rights and interests of dispatched workers in public institutions plays an important role.In view of the lack of legislation,it is necessary to perfect the legislation of dispatching labor service,formulate special regulations on dispatching employment of public institutions and perfect the labor standard method.To solve the problem of lack of labor rights,but also need to clear the workers,dispatch units and to send units tripartite legal relationship.In a clear basis,to play the role of legal regulation.Institutions and the Government in the protection of labor dispatch workers play an important role,play the role of institutions and the government.Institutions through reform and constantly improve their own employment system to solve the problem of equal pay for equal work.Play the role of government regulation,supervision of labor dispatch,provide a channel for workers to safeguard their rights.Stipulates that the dispatched units and the units to be dispatched shall be subject to criminal liability in violation of the provisions on dispatching labor services.
