| In China’s labor relations legal system,the main concern is the adjustment and norms of individual labor relations.Collective bargaining mechanism has not been really formed in the field of labor relations of China.Faced with this situation,China urgently needs to amend the existing collective bargaining system.The system of collective bargaining is a labor law system,which is one of the "three labor rights",and also is the adjustment mechanism of labor relations in market economy countries the most important part.It mainly related to all aspects of the subject,such as collective bargaining negotiation procedure,the contents of the collective contract,the collective bargaining security measures and dispute settlement system and so on.Including the system of collective bargaining,collective rights system has been existed more than and 200 years in the West.The system of collective bargaining is the core part of the labor relations system which worth the name of it because of its special function in improving labor standards,which enhance employees’ interests,which ease the labor conflicts,which resolve contradictions,which play a key role to ensure the stability and development of national economy and society.First of all,the research significance is illustrated.The values of collective bargaining in both theory and practice are analyzed.The urgency and importance of collective bargaining system are addressed.Furthermore,the research methodologies are explained,semantic analysis and empirical analysis.Finally,expected theoretical breakthroughs are forecasted,the ultimate goal of the dissertation is to contribute to the legislation of collective bargaining rights by carding and constructing the collective bargaining system theory while analyzing the abstentions and infringements of subject of rights.This article focuses on the data with the in-depth theoretical analysis of the right of collective bargaining.Then I choose USA and Japan as examples.I analyze the collective bargaining system of china.I analyze problems from 3 parts:the main system,security system and dispute handling procedures.Finally,I put suggestions from the three aspects forward to improve our collective bargaining system. |
