The Research On The Patent Strategy Of The Domestic Smartphone Companies Based On The Patent Portfolio Analysis

In recent years, domestic smartphone companies develop rapidly by the innovative driving strategies and cost advantages,with the expanding global market share. Meantime,patent litigation wars are staged. Huawei and ZTE in 2014 prosecuted millet, OPPO and other smartphone manufacturers for patent infringement. Smartphone industry is a high patent-intensive industry. During the enterprise technology development and market expansion, patent strategy lies in the core position. By analyzing the patent strategies and patent portfolios of these enterprises, on the one hand we can make them aware of their deficiencies about patent strategy and patent portfolio, and then they can adjust the patent strategy according to the patent portfolio stitution timely, and then make the appropriate activities under the correct guidance of patent strategy, so as to enhance their market competitiveness. On the other hand we can provide competitive intelligence information for the enterprises in the industry.Firstly, the paper establishes a company level patent strategy- patent portfolio theory model. In terms of the model, patent portfolio of the selected domestic 8 smart phone companies are analyzed and we find that Huawei and ZTE in the patent number and patent quality are both high; millet, Lenovo, OPPO, Coolpad and TCL's possess a high number of patents, but the unsatisfactory patent quality; and VIVO both in the patent number and patent quality are relatively low. In view of this, we draw the conclusion: Huawei and ZTE belong to the comprehensive patent strategy; millet, Lenovo, OPPO, Coolpad and TCL belong to the patent defense strategy; VIVO belongs to the marginal patent strategy. Secondly, the paper uses the technology level patent portfolio model on the basis of previous studies to analyze these companies in three technical fields. Finally, Combining the company level with the technical level patent portfolio analysis, we believe that Huawei and ZTE should adopt comprehensive patent strategy, millet, Lenovo, TCL, OPPO and Coolpad should adopt patent defense strategy, meantime VIVO should adopt a patent defense strategy.
