The Discrimination Of Public Notice And Noticification

The problem of mixing the Public notice with Noticification is not only a difficult topic in the academic research of logical definition, but also an operational challenge to discriminate Public notice from Noticification. Currently in theory and practice, there are many unresolved dispute about the research of definition and discrimination.Therefore, this ariticle tries to do the research based on the theory of legal hermeneutics, with the help of the Laws&Regulations basement of Peking University Centre for Legal Information.On the one hand, in the term of theoretical logic, the essay defines the essence of Public notice and Noticification, then clearly reveals the basic features. Moreover, we extract the practical rules in the difference of functional selectivity and writing.On the other hand, according to the classification of mixture, this article analyzes the reasons of mixture and compares Public notice with Noticification at the operational level.So that to resolve the problem,we bulid a set of operational process to discriminate Public notice from Noticification on the base of difference between them. Finally, the process is verified by the text examples from positive and negative two aspects.
