Research On The Construction Of The Legal Mechanism Of Energy Cooperation In The BRICS Countries

Since twenty-first Century, with the development of the process of globalization, the energy is becoming more and more important today.In recent years, with the development of BRICs' cooperation projects,and expansion in the field of energy cooperation, the BRICs relations become increasingly close.Energy cooperation is becoming a wise choice for the future cooperation of the BRICs. The basis for the study on energy cooperation regime is studying the reality and necessity study, learn from the foundation of the legal mechanism of international and regional energy cooperation, finally try to construct the BRICs legal system of energy cooperation. This idea conforms to the trend of the development of the BRICs, and supplement the lack of related research in the field, from the theoretical level, to solve the BRIC countries in the field of energy cooperation research provides a new perspective and method, the paper has four chapters.First chapter firstly studies the connotation and classification of energy cooperation regime.In order to understand the connotation of the legal system of energy cooperation, we have to understand what is the international cooperation mechanism, when the mechanism is applied to a variety of problem domains, it will produce different and the corresponding mechanism, and the energy cooperation regime mechanism is derived from international cooperation regime; secondly discuss the characteristics of legal system of energy cooperation and it's function, it will contribute to the construction of BRICs energy cooperation regime.The second chapter discusses the necessity and feasibility of establishing BRICs. energy cooperation regime.First of all, introduce the current situation of energy cooperation in the BRICs and the challenges in cooperation.,then discuss what is the legal mechanism of energy cooperation and the corresponding characteristics. Secondly, on the one hand, it is necessary to discuss the construction of BRICs energy cooperation regime. On the other hand, the introduction of the reality of the BRICs energy cooperation regime.The third chapter discusses how to chose BRICs energy cooperation regime,The third chapter discusses the selection of the BRIC countries legal system of energy cooperation.Firstly, the thesis introduces the three main international energy cooperation legal mechanism,including legal mechanism of IEA energy cooperation, EU energy cooperation mechanism and the Shanghai Cooperation Organization energy cooperation legal system, Finally, itdiscusses what BRICs energy cooperation regime should be,it need to signed a joint agreement, determine the target and principle of cooperation and so on.In the fourth chapter, the paper proposes the construction of BRICs energy cooperation regime, including three aspects: first, the establishment of the BRICs cooperation and strengthening its function, including the principle of cooperation, nature, purpose and internal structure of the organization.Second, the establishment of energy dispute settlement mechanism, information sharing mechanism, energy cooperation supervision mechanism, etc.Third, signed a multilateral agreement on energy policy, and the adjustment and regulation of the main power, trade barriers, investment protection and so on.
