At present,the deepening of economic globalization and international industrial division of labor and a new round of technological revolution and industrial revolution gave birth to the rise,the world economy is speeding up the transformation and upgrading,intellectual property rights in the strategic position in the global economy growing,the countries all over the world more and more attention to the protection of intellectual property.The global intellectual property rights and the development of the market competition presents the new situation,namely,innovation more urgent demand for patent protection,foreign patent technology competition and abuse of multiple patent protection,etc.According to the new situation,researching enterprise patent strategy,will help China’s enterprises of their own advantages and disadvantages and facing the opportunities and threats,to develop a patent strategy suited to the characteristics of the enterprise itself,improve the scientific,pertinence and effectiveness of enterprise patent strategy,speed up the enterprise resources to independent intellectual property rights and core competitiveness,and promote innovation ability,optimize the patent layout,reduce market risk,achieve sustainable competitive advantage and economic benefits,and the model for the concrete practice of the enterprise patent strategy in China.Piston ring based on the domestic industry leader in S company as an example,according to company S lack of systematic patent strategy problem,using the literature research,comparative study,case study,survey research,qualitative and quantitative research methods,such as the combination of research is mainly focused on the company S patent strategic positioning,formulation and implementation of security measures.This paper first summarizes the domestic and foreign scholars on the concept,classification and characteristics of enterprise patent strategy,meaning,influence factors and the empirical research and application of research progress and achievement.Secondly,the concept of patent strategy,strategic management and relevant research methods and tools are summarized.Then,from the perspective of patent,the use of PEST analysis,five analysis model and the patent information analysis method to analyze the macro environment,industry competition environment of S company and the major competitors,and analyzed in detail from the aspects of resources,ability and so on S company’s internal environment.On this basis,the analysis and sums up the advantages and disadvantages of S company and the opportunities and threats,SWOT matrix analysis to achieve the company S patent strategic positioning and draw,and implementing the patent strategy of security measures are put forward.In this paper,the conclusion is:according to the company S of different competitive position in domestic and foreign market,which is the industry leader in the domestic marketposition,the following is the status of the foreign market,the company S should be respectively formulate different patent strategies at home and abroad market.S company in China should be taken to give priority to in order to attack the SO strategy,mainly including patent strategy,commissioned development patent strategy,patent strategy and patent products output standard combination strategy;Taken abroad is given priority to with defense,settlement of offensive and defensive balance strategy,mainly including following patent development strategy,give priority to in order to circumvent each other patent patent defense strategy,mainly introduced and invalid patent patent application of patent strategy,and give priority to in order to cancel each other patents,prove to unavailability of patent defense strategy.At the same time,to ensure the smooth implementation of the patent strategy,the basic safeguard measures and special safeguard measures for the domestic and foreign patent strategies are formulated.
