The engineering supervision system in China is a system with Chinese characteristics.At present,the engineering supervision legal system in our country requires complex demands of professional obligations of the supervision engineer,which results in a mixed state of the right and power of supervision engineer.They not only need to exercise the rights from the owner that commissioned by the civil law,but also need to exercise administrative supervision power from the government through the laws and regulations.The complex mixed state highlights the unclear identity of the supervision engineer.Because of this,the supervision engineers are faced with a great career risk.At the same time,the supervision industry also expressed serious dissatisfaction and protest for its current situation.This paper is based on the view that "supervision engineer ia a post position".It is focused on the contents and requirements of the consultation service and quality and safety supervision service of the engineers under the traditional "design-bid-build" mode(DBB mode),according to the line of thinking of"post-work-obligation-responsibility".The professional obligations of supervising engineers are sorted and summarized according to their legal basis.Based on this issue,330 official judgments in force from 2014-2016 were read and sorted to show the full reality for the actual situation of the professional responsibility that are shouldered.On this basis,concernning to the new requirements in connection with the development of reform of China's construction industry,this paper trys to crack the supervision predicament and reposition the supervision service.At the same time,corresponding suggestions are put forward for supervision engineers to avoid professional risks and the development of the supervision industry.
