Study On The Public Participation In Environmental Impact Assessment In Perspective Of Two Kinds Of Interests

There are two aspects of the impact from human activities to the environment.Not only the environmental private interests are affected,but also the public interests of the environment are influenced.The two kinds of interests are closely interrelated while they are different from each other as well.Both of these interests shall be taken into account when the environmental statutes and policies are enacted.The purpose of adding public participation into the environmental impact assessment(EIA)is to take into the concern in maintaining both of the two kinds of interests.However,in reality,the protection of private environmental interests is fairly enough while the protection of public interests of the environment is far from adequate.The imbalance between the maintenance of two kinds of interests is reflected in participants,information disclosure,ways of engaging and relief of the rights.Therefore,it is necessary to reconstruct the system of public participation in EIA in perspective of two kinds of interests in environment.As far as the participant is concerned,the position of the representatives of environmental public interests especially the environmental NGO should be recognized.Also,the representatives of two kinds of interests shall have equal rights in terms of information disclosure,ways of engaging and relief of the rights.
