Study On Legislative Problems Of Rural Household Garbage Pollution Prevention And Control In China

With the advancement of the urbanization process,ecological deterioration and environmental pollution have been emerging while China's rural areas have achieved great economic achievements.Among them,garbage problem becomes the core of rural environmental problems.Due to the lack of effective management,the long-term accumulation has caused the pollution of rural household garbage to be seriously shocking.In 2015,the country released Guidelines for the Construction of Beautiful Village,and specific quantitative indexes are stipulated in the construction of ecological environment;In 2017,the ministry of environmental protection and the ministry of finance jointly issued The 13 th five-year Plan for the Comprehensive Improvement of Rural Environment in China,among which one of the main tasks is the disposal of rural household garbage.The implementation of a series of policy documents shows that the party and the state attach great importance to the rural environment in the decisive stage of building a moderately prosperous society in all respects.However,the lack of legal system is the root cause of the increasingly serious problem of rural household garbage pollution.The perfect legislative system and effective domestic waste management system are not only the objective need to control the pollution of rural domestic garbage,but also the urgent requirement to implement the strategy of rural revitalization and the construction of beautiful China.This paper is divided into four parts besides the introduction and conclusion:The first part summarizes the present situation of rural household garbage pollution in China.The paper defines the meaning of rural living garbage firstly,and they are defined as the rural household garbage that will produce in the countryside or are harmful to rural areas;secondly analysis points out the characteristics of rural household garbage pollution in China,the damage to soil,water and air,and the enormous waste of resources.Finally introduce the rural living garbage pollution control in China has made a series of results,such as: infrastructure continue to improve,the processing capacity significantly increased,environmental protection mechanism gradually establish,But there are still problems,such as poor handling of technology and inadequate supervision.The second part systematically analyzed our country rural living garbage pollution prevention generalizes the legislative system,the laws are analyzed from the legislative concept,legal status,legislative content and so on,and pointed out the problems,such as: the legislative idea of "valuing city and despise countryside",specialized rural solid waste pollution prevention law status is low,there are many regulatory clauses and few incentive clauses,the rural living garbage management system is not scientific,The law enforcement mechanism is imperfect,and the public participation mechanism is not perfect.The third part introduces the advanced experiences of the developed countries such as Japan,the United States and the European Union.The Japanese government's emphasis on rural ecological function and sufficient funds to ensure the rural living garbage in Japan can get effective governance.The environmental education system not only enhances the environmental awareness and quality,but also reduces the production of garbage.The high level of public participation in the United States enables rural household waste to be collected,recovered and processed in a timely manner,just like urban garbage.The European Union countries adhere to the concept of sustainable development,and have built a relatively sound legal system.The experience of these countries and regions for the governance in our country living garbage pollution brings revelation: to carry out the concept of sustainable development,establish a perfect legal systemIn the fourth part,the author puts forward the legislative proposal to improve the prevention and control of household garbage pollution in rural areas: the concept of " urban and rural areas as a whole" should be adhered to.In the legislative system,special rural environmental protection law should be issued as soon as possible,while the scientific nature and authority of local legislation should be promoted constantly.In the law to build the scientific content of the rural household garbage management system,perfect the legal safeguard mechanism.At the same time,the environment education is incorporated into the legal norms to improve the public's environmental awareness and improve the public participation mechanism.
