The Rule Of Law Guarantee For The Prevention And Control Of Agricultural Non-point Source Pollution In China

In recent years,China's rural economic development level has been continuously improved,and the material living conditions of the peasants have been improved.However,the ecological environment has been seriously damaged.Therefore,the agricultural source pollution has quietly become the key factor restricting the improvement of rural living environment and agricultural economic growth.Cadmium cadmium "wheat" and "rice",such as food safety problems,land desertification,soil total metal paint,water pollution problems such as no longer suitable for human consumption also reflects the emergence of the management work of agricultural non-point source pollution is imminent.However,the existed legal system of environmental protection in China is mostly aimed at point source pollution or urban environmental pollution,and there is little concern about the pollution of agricultural surface sources.Study of agricultural non-point source pollution in China starts late,the related management technology is also in the researching.so we need analyzing the causes of agricultural non-point source pollution,and exporing the diffculties among the agricultural non–point pollution,and various methords and means are adopted to provide legal advice on the legal system,law enforement and judical relief in the prevention and control of nonpoint agricultural pollution.Based on the domestic numerous examples as the background of agricultural non-point source pollution,makes a comprehansive analysis with the applycation the knowledges of economic law,theoretical law,economics and other disciplines,and studies the problems of agricultural nonpoint source pollution prevention and control to provide a legal guarantee for the prevention and control of agrical nonpoint source pollution in China.Specifically,this paper is divided into four parts,which are described as follows:The first part puts forward the problems of the rule of law.Points to multiple cases of agricultural non-point source pollution caused by different reasons,and aims to illustrate that the current agricultural non-point source pollution has been expanded situationally and has been caused serious environmental problems to soil,water,and ecological environment,so environment goverance is urgently needed.The second part is an overview of the prevention and control of agricultural surface pollution in China.This paper mainly analyzes the connotation of agricultural surface source pollution,and finds out its characteristics,and lays a theoretical foundation for the later analysis,and combines with the actual analysis of the actual situation of China's agricultural surface pollution.The third part is the prevention and cure of the pollution of China's agricultural surface source.This part focuses on the practice,analyzes the specific problems of each case,and analyzes the prevention and control dilemma of agricultural surface pollution in China from the perspective of legislation,governance,monitoring and accountability.The fourth part is the evaluation of the operation effect of current laws and regulations in our country.In this part,we deeply analyze the legal system of China's prevention and control of agricultural pollution,especially the combination of environmental public interest litigation.To absorb the excellent experience of foreign governance,to provide valuable Suggestions for the prevention and control of agricultural pollution in China.The fifth part is the conception of the rule of law in the prevention and control of agricultural surface pollution in China.Under the existing legal system,separately from the legislative,law enforcement,judicial,executive and corresponding economic means,clear the guiding ideology of agricultural non-point source pollution control work,puts forward the idea for better prevention and control of agricultural non-point source pollution and the suggestion.
