Research On The Legislative Path Of Ecological Conservation Redline

Due to the rapid development of the global economy,the ecological environment where human beings are living has been constantly being destroyed,and the situation is not optimistic.In order to cope with global ecological crisis and protect China's national security,China proposed the“Ecological Conservation Redline” as an innovative concept.This concept was also mentioned in the newly revised Environment and Resources Protection Act of 2014 and the specific delineation was pointed out in the new act.The emergency of the ecological conservation redline is not only a rational choice for coping with the deteriorating ecological environment,but also a necessary way to reform the system of the existing environmental protection management,what's more,it is a basic condition for optimizing the national ecological security pattern.Its necessity is self-evident.As a result,the central and local governments have carried out the delimitation and protection of ecological protection redlines one after another.But what we have to admit is that the running of the ecological protection redline is still at an exploratory stage,problems have arisen in the process of redline designation,which has caused many difficulties to environmental protection.Based on the current status of the ecological protection of the redline,the paper finds that the ecological protection redline system has no specific legislation to give guidance at the country level,with a low level of legal effectiveness and scattered types of laws and regulations,and other issues.At the same time,taking the practical status of the ecological protection redline as an entry point,the paper finds out the problems in some aspects,such as the specific implementation of the standards,control system,ecological compensation,and legal accountability for cross-line violations.Then the problems existing in legislation of ecological protection redline have been deeply analyzed from the subjective and objective perspectives in this paper.Finally,on the basis of drawing lessons from the practical experience of the ecological protection redline at home and abroad,suggestions are proposed toimprove the legislative path of the ecological protection redline in China.The main purpose is to call for the state to issue special ecological legislation for the protection of the redline,and in the legislation,to unify the legal connotation of the ecological protection redline and improve the supporting laws and regulations;in the implementation phase,the scope of the redline should be delineated scientifically and redline should be adopted to control the ecological space;in the protection,the ecological compensation of the redline is expected to be increased,the public participation also be increased,and the ecological protection coordination of the redline ought to be established.The ecological protection of redline and more lines of legal responsibilities should be enhanced.The purpose of the proposal of these suggestions is to manage the sneak peek,and to provide effective guidance for the implementation of China and make it more approaching perfection.
