On Environmental Protection Administrative Interview System

Since October 2014,environmental protection administrative interviews has become the“rising star "of the environmental protection administration field.Not only the Ministry of Environmental Protection,but also the environmental administration interviews have been introduced the local environmental protection department.Although the current environmental administration interviews is in full swing now,but there are still same problems,such as the definition of administration interview in environmental protection is not unified,the legal attribute of administration interview in environmental protection is not clear;the rule of the interviews entity does not match the environmental protection supervision system;the scope of interviews object is too narrow and the rule of interviews object are inconsistently;the start matters much tendency to pollute the "end of governance”and poor operational of the interview process;interviews delay,challenge system and period of interview are lacking in interviews process;responsibility is lacking in administration interview in environmental protection.At present,the most important is to improve the administration interview system in environmental protection.In theoretical research,uniform the concept of administration interview on environmental protection;to determine the legal nature of administration interview in environmental protection is a new type of non-mandatory administrative behavior.In the construction and improvement of the system content,we need to expand the scope of the interviews entity,all government departments with environmental administrative functions should be interviews entity;to unified central and local agreement on the object of inconsistencies and increase party leadership for the interviews object;to expand the scope of interviews start matters further standardize the standard,and to increase assessment on the interview start process;to improve the other aspects of the interview process,such as increase the rule of delay,challenge system and period on interview process;to improve the rule of information publicity and public participation on interviews process;to standard the supervision and feedback of the reform of interviews,improvement responsibility of administration interviews in environmental protection.The final solution is that the State Council to enact "Environmental Protection Interviews Regulations",the elements of administration interviews system in environmental protection shall be uniformly prescribed by the regulation.
