Since the establishment of the nature reserve system in China,significant achievements have been made in the field of ecological environmental protection.With the expansion of the scale of nature reserves,the development of basic theories related to nature reserves,and the practice of relevant mechanisms in nature reserves in the world,the system of simply adopting the “barrier-type” protection model has gradually shown a disadvantage.In particular,with the development of international and domestic human rights laws and regulations and the improvement of citizens' human rights awareness,in the traditional sense,nature reserves generally have freedom of residence and migration and property rights for local residents in planning,delineation,management and management.Deprivation and other issues,in the final analysis,the current "Regulations on Nature Reserves" lacks the protection of their basic rights to know,participate,and property rights,and the superior law is still lacking in norms.With the development of environmental laws at home and abroad and the enrichment and improvement of relevant theories,the theory and practice of the nature reserve system as a member of the environmental legal system is also constantly improving and developing.The traditional “barrier” protection to “symbiosis” "Property protection",international conventions promote the internationalization and communalization of the system of nature reserves,the coordination of the relationship between local residents and the ecological environment and the consistency of interests are constantly recognized,and the future of China's nature reserve system has received more and more attention.This paper analyses the basic categories of nature reserves,the historical traceability of nature reserves,the mode selection of nature reserve systems at home and abroad,and the evolution of legal norms in nature reserves insufficient protection.With the call for the revision of the relevant laws and regulations on nature reserves in China,the National Park Reform Pilot Program proposed this article to select several countries with relatively mature natural reserve systems and rich experience.The outstanding advantages of the two aspects of the legal rights of substantive rights and procedural rights are investigated and interpreted.The intention is to improve the legal norms of the nature reserve system in China,and even provide operational reference for the transition from the nature reserve system to the national park system.
