A Research Of Perfecting The Legal System Of The Subject Of Appraisal And Assessment Of Environmental Damage

At present,China's environmental situation is not optimistic.With the rapid economic growth,pollution and damage to the environment are not uncommon,but the people's attention to the environmental situation is increasing.In this case,if we want to solve environmental disputes reasonably and maintain social equity and justice,we must have a perfect legal system of environmental protection to deal with the increasingly severe situation.In this system,environmental damage assessment must be the most important part.In the process of perfecting the environmental pollution damage assessment system,we should start from the most urgent part and the largest proportion,choose the main body of environmental pollution damage assessment as a breakthrough,and gradually improve the legal system of environmental pollution damage assessment in China.At present,there are few academic studies on this subject,and the scope involved is not comprehensive enough,and the solutions to the problems are not detailed enough.Therefore,it is very important to analyze and find out the deficiencies of the legal system of the subject of environmental damage appraisal and assessment systematically and comprehensively,and put forward the solutions separately.It has academic significance.This paper makes a comprehensive use of literature analysis and comparative analysis,which is divided into four parts.Firstly,it discusses the background and significance of the legal system of the subject of environmental damage appraisal and evaluation,and the research status at home and abroad.The second part is the practical investigation of the legal system of the subject of environmental damage appraisal and evaluation,and defines its concept and analyzes it.The third part analyzes the six major problems in the subject of the legal system of the main body of environmental damage appraisal and assessment in China,which are different qualification standards,lack of authority of expert pool,weak supervision,unclear legal responsibility,insufficient information disclosure and anomie of appraisal fees.Some suggestions on perfecting the system of the major of environmental pollution damage appraisal and assessment in China are put forward,which correspond to relevant problems.The paper makes a comporehensive and systematic improvement by: perfecting the way of qualification,optimizing the component part of appraisal and assessment system of environmental pollution damage,establishing the comprehensive supervision,hardening the responsibility system,reducing the information cost,and improve the charges system.
