Study On Legal Issues Of Green Packaging

China is currently the second largest packaging country in the world.With the rapid development of packaging industry,the problems of environmental pollution and resource waste caused by packaging are becoming more and more serious.Due to the lack of unified packaging management legislation and the lack of sufficient attention to the concept of green packaging in China,the harm caused by packaging to the environment is becoming more and more serious.The development of green packaging is the requirement of developing cleaner production,realizing the important strategy of developing circular economy and carrying out the concept of green development.It is also beneficial to the construction of resource-saving and environment-friendly society,and finally to the sustainable development of society.This paper consists of five parts:the research on green packaging,the present situation of international green packaging legal system,and the present situation of China's green packaging legal system.The necessity and feasibility of constructing the legal system of green packaging in China and the suggestion of constructing the legal system of green packaging in China.Firstly,the connotation of green packaging,the relationship between green packaging and environmental protection,and the theoretical basis of green packaging are analyzed.Green packaging is a kind of appropriate packaging which can recycle,reuse or degrade corruption,and does not cause harm to the environment in the whole life cycle of the product,which conforms to the concept of sustainable development and the concept of green development.The development of green packaging meets the requirements of circular economy theory and producer responsibility extension system,conforms to the concept of green development,helps to save resources and energy,and reduces the environmental pollution caused by packaging.It is the best way to coordinate the development of packaging industry with environmental protection.Secondly,through the investigation of the foreign green packaging legal system and the research and analysis of our country's green packaging legal system,the author compares and draws lessons from the beneficial experiences and practices of foreign countries in the legal control of green packaging.This paper mainly studies the salient features of relevant laws and regulations of EU,Germany and Japan.At the same time,by investigating the current situation of packaging laws and regulations in China,we find that there are three major problems in China's green packaging legal system:the current packaging laws and regulations lack of system construction,the lack of unified and centralized legal regulation on green packaging;Development of green packaging supporting system is not perfect,green packaging implementation of environmental supervision system is not smooth.Finally,some suggestions on the legislation of green packaging in China and the construction of legal system of green packaging in China are put forward.It mainly includes:establishing a green packaging law,carrying out green tax system,packaging mortgage system,establishing packaging classification and recovery system,green packaging subsidy system and developing green packaging special fund guarantee system.
