Study On Legal Problems And Solutions Of River Chief System In China

In recent years,water pollution accidents have occurred frequently in China,and the overall situation of the water environment is not optimistic.In order to effectively curb the continued deterioration of the water environment,through the absorption of local experience,the Central Office and the State Office jointly issued the “Full Implementation of the River” in 2016.The Long Opinions,the Water Pollution Prevention Law,also officially established the river length system in the 2017 revision.The establishment of the river system has effectively implemented the local government’s environmental responsibility.The party and government leaders can serve as the chief of the river to coordinate and integrate the forces of all parties and promote the comprehensive management and protection of the water environment.As a new water environment administrative management system,there is still room for improvement in the river management system at the normative level.The research on China’s river system is mainly based on the investigation of the status quo of the river system,the legal issues of the river system and the corresponding improvement measures.The investigation of the status quo of the river system is mainly divided into: the investigation of the status quo of the river system and the examination of the actual effect of the river system.Through the textual examination of the river system,it is found that the current policy is mainly to promote the construction of the river system,and the environmental law is in a weak position.As far as the effective inspection of the river system is concerned,it has a significant role in implementing the government’s water environment responsibility and improving the efficiency and effectiveness of water environment management.Through the above investigations,it is found that the current legal problems of the river system in China are mainly concentrated in the following four aspects: First,the shackles of the main body of the river system,including narrow scope and selection criteria are not clear and specific;secondly,the responsibility of the river chief The problem is mainly the illegality of duties and the homogenization of duties;again,the four problems of the evaluation and evaluation system in the river management system are not unified,the content of the assessment is not clear,the evaluation and evaluation methods are insufficient,and the form of responsibility is unclear.Finally,through the analysis of the supervision system of the river system,it is found that the current supervision system of the river system has problems such as the lack of supervision by the people’s congress,the lack of judicial supervision,and the lack of social supervision.Through the analysis of the above problems,this paper proposes the following countermeasures: First,the main body in the river system should be established from the scope expansion and the legislative criteria of the selection criteria.Second,the issue of the responsibility of the river chief should be clearly defined by legislation.Thirdly,the construction of the evaluation and evaluation mechanism is mainly realized by clearing the main body of evaluation and evaluation,setting the content of scientific assessment and evaluation,improving the evaluation and evaluation methods,and defining the form of responsibility commitment.Fourth,through the complementation of the supervision of the National People’s Congress,the convergence of judicial supervision and the strengthening of social supervision,the supervision mechanism of the river system is improved.
