Research On Legal System Of Environmental Pollution Liability Insurance In China

With the rapid development of the economy,while the social material information is constantly enriched,it has also brought a series of problems such as environmental pollution.The severe current situation of environmental pollution has awakened the public's enthusiasm for environmental protection and raised the concept of compensation for environmental tort damage.For our country,it is necessary to maintain the stable development of the national economy and reduce the pollution pressure of highly polluting enterprises,but also to protect the environment,disperse environmental pollution risks,and protect the interests of environmental pollution victims.Under such a social situation,environmental pollution liability insurance has become an important issue that affects the social stability and long-term development of our country.From a legal perspective,environmental pollution liability insurance can be viewed as a legal technology based on environmental tort liability to diversify environmental pollution risks.Therefore,this article focuses on how to build an environmental pollution liability insurance legal system that suits China's national conditions.The full text is divided into five chapters.The first chapter is the introduction,expounding the research background and significance of this thesis,sorting out the research status of this topic by domestic and foreign scholars,and explaining the main research content of this paper;The second chapter defines the concept of environmental pollution liability insurance,analyzes its characteristics and functions,and analyzes the differences between environmental pollution liability insurance and other relevant legal systems;The third chapter analyzes the plight and reasons of the current environmental pollution liability insurance legal system on the basis of combing the practice process of China's environmental pollution liability insurance law.It points out that China's current environmental pollution liability insurance legal system has a series of problems such as an incomplete environmental pollution liability insurance legal system,unclear insurance nature,and unclear coverage;In the fourth chapter,we investigate and analyze the legal systems of environmental pollution liability insurance in Germany,the United States,and Japan.We mainly analyze the overall system status and legislative characteristics.We hope to learn from advanced experience and learn lessons;In Chapter 5,in view of the problems existing in China's environmental pollution liability insurance legal system,we put forward suggestions for improving the role of environmental pollution liabilityinsurance in dispersing environmental pollution risks,protecting the rights of victims,and strengthening the awareness of environmental protection.
