In today's society,mental health has become an important social and public health problem.On May 1,2013,the Mental Health Law of the People's Republic of China was formally implemented.Involuntary hospitalization of mental disorder patients includes compulsory involuntary hospitalization by the state and deterministic involuntary hospitalization by guardians.The legal content and existing problems of two kinds of involuntary hospitalization are analyzed based on the relevant legal provisions of the Criminal Law and the Mental Health Law and the involuntary hospitalization of mental disorder patients in real life.The first part of the introduction,analysis of the background and significance of the topic,the introduction of domestic and foreign related research status quo,the article's research objectives,methods and content,to solve the key issues and innovation points;The second part of understanding the concept of mental disorders,analysis of mental disorders patients low attendance rate;The third part of involuntary hospitalization of patients with mental disorders legal provisions,the elements of involuntary hospitalization classification,to explore three kinds of involuntary hospitalization problems;The fourth part puts forward the principles of procedural justice,automatic review mechanism,rescue system,community rehabilitation system.Based on the analysis of the problems existing in the involuntary hospitalization system for patients with mental disorders,and on the basis of drawing lessons from the relevant laws and regulations of foreign countries,adhering to the principle of procedural justice and the principle of the best interests of patients with mental disorders,in order to better protect The legitimate rights and interests of patients should coordinate the contradictions and conflicts between the rights of patients with mental disorders and public safety.Figure2;Table5;Reference 61...
