The medical service industry is a major necessity to meet the needs of the people.Medical Services from the birth of new life management to the treatment and rehabilitation of the public,and even life and death,throughout the life of people.There are a large number of medical service industries in our country,but the main medical service institutions in our country are public hospitals.Our country's public hospitals are the state public welfare institutions,providing basic medical services for the people as the purpose.It has played an important role in safeguarding citizens' right to life and health.With the increase of social wealth value,the development and reform of public hospitals are also in full swing.In the new era,people attach importance to their own physical condition.With the development of self-media,science popularization has become easier and people are more willing to believe in science.Out of the old ideas and folk prescription,people pay more attention to health,but also willing to go to the hospital for formal consultation and treatment.However,with the deepening of the marketization process of health care reform,public hospitals have also taken a leading position in the market.Under the influence of the market economy and the reduction of government financial input,it is difficult to maintain the normal operation of public hospitals for their own business activities.Therefore,the public hospital deviates from the public welfare behavior,and the pursuit of economic interests leads to the deviation of the public hospital.For a long time,the government has taken the direct management way to the public hospitals in our country.Under the pressure of National Financial Investment,the government hopes that the reasonable management of the hospitals themselves can share some of the pressure.Therefore,the government and hospitals have formulated a series of policies one after another,but also have a negative effect,such as even as a medical worker to save lives,but also in the introduction of medical treatment,making patients become the victims of business misconduct.Moreover,the nature of public hospitals and the existing system in the process of rapid development in China,there are many bad.Waste of social resources and harm to the rights and interests of consumers happen from time to time.To explore a reasonable and effective regulatory model of public hospitals,and to regulate the management behavior of public hospitals within the scope of safety,are the problems that need to be solved urgently in the new medical reform.To promote public hospitals to play a great "public welfare",to promote the allocation of social resources,so as to better serve the public interest,become an important direction of development.In the process of the new medical reform,public hospitals are facing several outstanding problems: First,the situation of medical care by drugs still exists in our country,and medical care by drugs is reasonable under certain social background,but with the passage of time,the old ways can not be applied any more,so reform is needed to facilitate the decoupling of medical treatment from drugs.Secondly,the management of personnel is also a major problem for public hospitals,as is the unreasonable performance appraisal mechanism,it has led to a deviation in the work of medical staff,which has led doctors to place too much emphasis on economic efficiency in order to assess their grades.Again,public hospitals function differently from private hospitals,its nature determines that public hospitals should adhere to the development of public welfare,unshakable.This study will explore the functions of public hospitals and how they can be enhanced by government regulation.Then,with the rise of the Internet industry,Internet hospitals will push public hospitals on the path of innovation and innovation in the face of new things,how to forecast its development direction and the possible existence malpractice,in the legal regulation temporarily imperfect situation,how to solve the anticipated possible problem through the legal application;finally,the research on regulation of public hospitals is to enable public hospitals to give full play to their public welfare nature,but public hospitals,as an enterprise legal person,are an independent operating subject,and it is inevitable that irregularities will occur in the course of operation,therefore,the supervision mechanism is very important,through the omni-directional,multi-level supervision mechanism to promote the rational operation of public hospitals.This study explores the subject status of public hospitals and the types of regulation modes corresponding to different types of subject status,and analyzes their differences from the perspectives of benefit distribution,personnel management and government supervision.Combining the characteristics and nature of public welfare of public hospitals in China,and combining the theory of public legal person and the theory of Public Property System,this paper explores the regulatory model suitable for public hospitals in China.Then,in view of the existing problems of our country's public hospitals,the appropriate regulation methods are put forward.On the basis of maintaining the public welfare of public hospitals,this paper provides some suggestions for the regulation mode of public hospitals in China.It also puts forward the optimization strategy for the prominent problems in the current regulation process of public hospitals.
