| Objective:This paper mainly focuses on the impact of the use of new medical technology on social family ethics in China,combined with the current more controversial three related ethical issues in society,from China’s traditional cultural level,contemporary social values and legislative level analysis,to find the current legal provisions of the rationality and direction of development.Through the study of the social ethical problems faced by human sperm bank,every step of the use of human assisted reproductive technology is in line with the provisions of national policy,but also avoid the conflict between the application of new medical technology and social ethics and social culture.It is hoped that the new medical technology can be developed and applied at the same time,without losing the bottom line of traditional ethics and the core and characteristics of Chinese culture.Method:The literature method and comparative analysis method were selected in this study.Collecting nearly 20 years of Chinese and English references through databases such as CNKI,Ebsco Medine,and pubmed,a total of 936 documents were collected in Chinese and English,such as "sperm bank," "assisted reproduction," "ethics," "Confucian ethics," "law," "single female reproductive rights," and so on.Remove 344 references by browsing the literature summary.By further referencing the subject matter and content of the article,the remaining 121 documents are Chinese 79 and foreign literature 42.Through the school library and other network channels,with traditional Confucian culture,family and blood,sexual culture,male infertility,ethics and other themes,collected 46 reference books,of which 36 Chinese books,10 foreign books.By organizing the legal provisions of Western countries in human assisted reproductive technology,the United States,The United Kingdom and Sweden have been chosen as the main reference objects in the legal analysis of this paper,according to the official websites of governments.Through the collected references and books,some of the relevant ethical issues facing human sperm banks have been studied,and the background of the establishment of human sperm bank(including the development of human assisted reproductive technology,the history of traditional Chinese medicine for male infertility,etc.)Through the analysis of Confucian traditional culture and contemporary cultural concepts,the ethical basis and cultural basis of the relevant legal provisions of our country,this paper discusses the social ethical factors that cause the ethical problems faced by human sperm banks and the legal factors that are divided withthe West.Result:An analysis of the cultural factors of the social ethical problems faced by human sperm banks in China: the use of human assisted reproductive technology,especially human sperm banks,is far from the traditional Confucian culture with the emphasis on kinship,the concept of family as the main,but with the contemporary sociological theory of individual-oriented,blood and family as a supplement to the concept of coincidence;The regulation of sexual culture in the traditional society in the marriage system is one of the reasons why the reproductive rights of single women cannot be recognized,and today’s society is a legalized society advocating affirmative action,and gender equality has become the mainstream view in the society,which is the main reason why single women demand reproductive rights.An analysis of the ethical basis of three relevant legal provisions of human sperm bank in China:(1)prohibits single women from having children.It is considered that "single female reproductive right" is not in line with the principle of "proper name" of traditional Confucian culture in our country,and the product of sexual culture(fertility)is standardized in the system of "propriety" in the institution of marriage.(2)the principle of mutual blindness.Under the influence of Confucianism attaching importance to kinship,the principle of mutual blindness is based on the consideration of protecting the families of both sides,as well as the protection of the "right to privacy" which is valued by people.(3)the principle of prohibition of commercialization.The nature of human gametes is not currently defined and,out of a conservative attitude,the possibility of "buying and selling human organs or tissues" should be avoided.The prohibition of commercialization is also in line with the content of traditional Chinese righteousness and benefit,which is regarded as a public welfare activity.Conclusion:Human assisted reproductive technology and human sperm bank are effective solutions for men’s infertility patients and their families in the short term that reproductive medicine can provide under conditions where male infertility cannot be completely cured.At present,the social family ethics problems faced by human sperm bank in our country are mainly the traditional Confucian ethical concepts and contemporary ethical concepts,the ancient and modern concepts of blood family ethics,the differences between the ancient and modern concepts of fertility and marriage andfamily,and the social family ethics conflict caused by this new technology,and the relevant legal norms in the field of human assisted reproductive technology in our country.Is based on our country’s cultural concept,in line with the Confucian ethical norms,the future development direction of the relevant legal construction should also be combined with the contemporary cultural concept and social value-oriented requirements,combined with China’s traditional Confucian ethical thought and contemporary Chinese and Western cultural integration stage of social values,the establishment is not only in line with China’s cultural characteristics,And keep up with the development of the times of the relevant legal system. |
