The Application Of Foreignization And Domestication In The Translation Of English Contracts

Since the 19th CPC National Congress last year,China has "opened its doors wider"to the world.As a result,sino-foreign equity and cooperative joint ventures are established more frequently with the conclusion and translation of relevant contracts becoming much more important than ever.In recent years,extensive studies and researches on legal translation have been carried out among Chinese scholars.Yet,a large number of them focus on the features of legal language and translation methods accordingly.Few have been conducted from cultural aspects,or from the aspects of foreignization and domestication.Based on this translation practice of the Sino-Foreign Cooperative Joint Venture Contract,this study conducts a deep analysis on the foreignization and domestication of vocabulary,syntax and discourse in the translation of this English contract.The following conclusions are drawn in the end:in legal translation,foreignization and domestication should be adopted in a flexible way.Foreignization helps bring novel legal terms and spirits into the target legal culture;domestication,or industry domestication in particular,is adopted to meet specific industry norms and requirements of target language,thus rendering more readable and acceptable texts.It can be predicted that as legal innovations and interactions between countries grow,foreignizing strategy will be employed more frequently,which also facilitates the communication of different legal ideas and thoughts.
