With the increasing diversification of academic research,the boundaries between academic fields are becoming increasingly blurred.By combining law with literature,this research method can not just expand the research horizons of jurisprudence,sociology of law and legal history,so as to make up for the deficiency of law education.Moreover,it is possible to provide a new research idea for the research of other disciplines.It is based on this that this paper is based on the traditional Kunqu opera“Fifteen String of Cash",trying to use the limited knowledge of jurisprudence combined with history and literature to study the judicial system and judicial culture in ancient China.And analyzes its possible enlightenment significance to the judicial construction of contemporary China.In view of the fact that this paper is about the study of law and literature,the first part explains the research background of law and literature,on the law and literature of the association of the model made in detail,and elaborates the significance of this paper and literature review.Since the text selected in this paper is Kunqu opera"Fifteen String of Cash5,,this paper also combs the contribution of Kunqu Opera to the study of law,and briefly describes the plot of the story of "Fifteen String of Cash".On this basis,the second part of this paper is close to the judicial treatment of the case inc"Fifteen String of Cash",and analyzes the ancient judicial system problems,including the trial mode,level jurisdiction and evidence problems,questionable judgment,etc.In the third part,this paper attempts to analyze the judicial culture contained in "Fifteen String of Cash" from a historical point of view,including advocating the plot of th honest officials,advocating the principle of morality,supporting punishment,rejecting judicial independence,and pursuing non-lawsuit value,etc.Some common problems in Chinese traditional judicial culture are discussed by means of mutual verification of literature and history.The fourth part puts forward some enlightening suggestions for the contemporary judicial construction according to the causes of the occurrence of unjust cases in "Fifteen String of Cash" and the current judicial situation. |
