A Study On The Relationship Between Land Contract And Land In Yinjiang In Qing Dynasty

Since the Ming and Qing Dynasties,the trend of land sale in the traditional villages has been more and more prosperous.After visiting Yinjiang village for many times,I have the honor to collect 175 land sales contract documents from zhaojiaping group and qibaidu village in pingcun,Guangdong Province,from K angxi to Xuantong,basically spanning the Qing Dynasty,including four categorie s: permanent sale contract,pawn contract,transferred pawn contract and land as offset.Through the research,we can get the information of the transfer of land rights,the development of social economy and the local conditions.By analyzing the form and type of the contract,it is found that its transacti on process and writing procedure are basically consistent with the national syste m,but it also retains its own characteristics.For example,taking the buyer as th e contract maker,writing habits mixed with common sayings,and the measureme nt methods are mostly "hills" and "blocks".In the process of land sale,the land right changes with the completion of the transaction.However,no matter how many times the same land is transferred and how long the time interval is,peop le will still reserve the right of redemption for the owner.This phenomenon sho ws that under the premise of complying with the relevant laws of the state,peo ple will also follow the local social habits to deal with the problems,which refl ects the social operation of human feelings in the Yinjiang river.The frequent tr ansfer of land right,the fluctuation of land transaction price,the difference of tr ansaction currency in different periods and the emergence of loan economy all s how that the development of rural economy in Yinjiang is full of vitality.Taking contract documents as the research object,based on the reality,this paper analy zes personal activities and customs,in order to highlight the rural social situation,reflecting the research path of social history and ethnology.By analyzing the land contract of Yinjiang River,we can see the rural econ omic situation,agricultural reclamation policy,water conservancy and irrigation si tuation at that time.So as to fully understand the local history and protect the l ocal historical and cultural relics.It can also provide historical experience for fa miliar with the regional development of Yinjiang,and provide reference for furth er study of Yinjiang contract documents.
