Throughout the recent judicial judgments,many cases,like "Ma Jiajue Case","Xu Ting Case" and "Yu Huan Case",have been affected by public opinion to some extent,which led to re-judgment or commutation.The commutation of the Yu Huan case brought the raging "Insulted Mother's Case" to a close,and the dramatic change in sentencing was closely related to the trend of the one-sided public opinion.But we have to admit that through some media reports,the case aroused strong public opinion about the fairness of the first-instance judgment,so the public opinion clamored for Yu Huan.The turbulent public opinion caused strong public opinion pressure on the court of second instance.While such similar public opinion had a significant impact on the result of the verdict,which has changed from supervising justice to interfering with justice.The commutation of Yu Huan's case has triggered a series of questions on public opinion,and the value of judicial trials draw our consideration.This thesis tries to analyze and interpret the phenomenon of public opinion of Yu Huan's case from the linguistic perspective.The corpora were collected from different voices from the media,such as legal experts with professional discourse power,major online media reports,public reposts and comments.The consciousness behind their language is analyzed,and the morphology and the linguistic characteristics of the we-media discourse in this case are interpreted.Based on that,the author tries to figure out how these linguistic characteristics lead the public opinion to one side,and sometimes the case could be commuted by the huge public opinion.The purposes of this thesis are to guide the public to speak rationally in cyberspace and change their stereotypes,to promote the benign interaction between public opinion and the judiciary,and to reshape the voice of the judiciary.This study selects nearly 40,000 words of corpus for linguistic analysis as the first analyzed part,which are mainly the comments after the announcement of first and second trial results.With the help of the corpus retrieval tool Antconc,the corpus is quantitatively analyzed,and the emotional factors and the ideology behind violent language are studiedby doing critical discourse analysis.Later,the researcher conducts a qualitative study of the corpus by using the appraisal theory to observe the language characteristics of we-media masses in this incident.The author hopes to interpret the research results from the aspect of China's judicial environment and emotional resistance.The results of the analysis show that through retrieval and other means,it can be found that "labeling" and "stigmatization" are common in public opinion,and most of these terrible language phenomena present weak legal awareness from the media;attitude resources and engagement resources account for the large proportion of first-instance and second-instance judgment reviews;and the difference lies in the different emotional objects discussed in first-instance and second-instance judgment reviews among we-media.After the first trial,negative attitude resources flood on the various we-media platforms,mainly manifest in dissatisfaction with the trial results,show their social anxiety,doubt and opposition,and also anger to functional departments of government,but they almost all express appreciation for Yu Huan.After the second sentence of commutation,the masses of we-media people become more rational.Negative attitude resources are mainly aimed at social issues such as illegal fund-raising and debt.Positive attitude resources are used to affirm the second instance sentence reduction,and people regain confidence in judicial institutions.We-media people use alignment,homogenization,and assertive languages to express their opinions,directly transmitting their emotions to other netizens,thereby affect the overall attitude of the public opinion field and finally shake the verdict to some extent.
