Study On The Influence Of Basic Rural Operation System On The Realization Of Peasants' Land Property Rights

Farmers will be given more property rights.Respecting and protecting the rights is one of the focus of Party and national policy,and increasingly absorbed by the national legislation.The peasants' land property right is the core component of the peasants' property rights.Empowerment is important,but the full realization of the rights is more significant.How can let these peasants' land property rights more fully realized,it is a matter of the prosperity of the state and social stability of the major issues.The realization of right should be restricted by many factors,and the peasants' land property rights are the same.Such as land property rights system,land circulation system,household registration management system,these are to some extent,affect the realization of peasants' land property rights.This paper will focus on the impact of the basic rural operating system on the realization of peasants' land property rights.Under the background of the rural development of the “new four modernizations”,great changes have occurred in the basic rural operation system.New agricultural management system is gradually formed.The development and changing of diversified management mode which taking the moderate large-scale management as the goal and a variety of management subject which taking the family farm,farmer cooperatives,agricultural leading ent erprises as a typical provides greater space and possibility for farmers to exercise and realize the right of land property.Based on this,starting from the influence that the basic rural operation system on the peasants' land property rights,this paper intends to analyze the implementation status of peasants' land property rights in different period of the basic rural operation system,to investigate the impact on the realization of peasants' land property rights under the situation that the innovation of current double management system connotation and the collective economic revival and expansion.And then explore how to improve the basic rural operation system,in order to further promote the realization of peasants' land property rights.The basic rural operation system is a double layer management system which takes the household undertaking management as the foundation.After a long period of development,it has gradually formed the organic unity of the agricultural management system by management subject and mode.We can find that the construction of new agricultural management system proposed by The Central Party committee is a correct rural policy with far-reaching significance by combing the ways and problems of realization of peasants' land property rights in the traditional agricultural management system.Compared with the traditional system,the new agricultural management system pay more attention to cooperation and community,provid ing more abundant channels and means for the realization of peasants' land property rights.But there are still shortcomings in practice,mainly for the forcing land circulation against the wishes of farmers in the agricultural production and operation,contrary to the objective laws of blind expansion of the management subject,the unclear legal status of the land stock cooperatives,the lag of legal system of the mortgage of the land contract and management rights and so on.In this paper,through in-depth analysis and research on these issues,we believe that efforts should be made from four aspects to improve the rural basic operation system and promote the realization of peasants' land property rights.That is,perfecting the legal system of the circulation of land contract and management rights,developing new management subject reasonably according to local conditions,perfecting the legal system of the land stock cooperatives,and constructing the legal system on the mortgage of the land contract and management rights.
