Research Of The Punitive Compensation In Food Safety

In recent years,domestic food security incidents aroused public awareness of food safety issues unprecedented attention.Food safety issues to the public caused serious bodily harm and property damage,and the whole society is enveloped in a huge shadow.Punitive damages were introduced to domestic law,which shows the determination of state legislature to regulate food safety issues through legal means.Punitive damages was Investigated by Chinese domestic law scholars actively,and they have reached a higher level of awareness in the system design and practical experience.Currently,Punitive damages has been prescribed in many domestic civil law.But on the whole,there are still many problems in the Chinese punitive damages system,and its further research is necessary.This article is based on this idea,hoping to be helpful to the relevant theoretical research.Besides the introduction,the article is divided into four parts.The introduction introduces the research background of the paper,and define the boundary of the article.The first part describes the connotation of punitive damages,combined with China's actual demonstrated punitive damages in solving the problems of food safety on the practical significance.Established in China punitive damages is an effective solution to the problem of food security needs,is to develop public awareness of the rights of the need for our country to further adapt to the needs of international contacts.The second part of the in-depth analysis of the domestic legislation in the field of food safety regime for punitive damages law,discusses their application conditions,advanced and weaknesses,and they apply between competing issues are analyzed.The third part discusses the UK,the U.S.and Taiwan of China in the field of food safety punitive damages,punitive damages for their research scope,constitute conditions,standards and other requirements in respect of the amount,and analyzes of foreign advanced system to our punishment compensation Law for the perfect inspiration.The fourth part is based on the consolidated above,this paper proposes to further improve the system of punitive damages several legislative proposals:expand food safety issues punitive damages on the scope of establishing a more equitable and easy to operate compensation standards,improve food safety harmonization of standards,improve food safety issues competing punitive damages,litigation system in the Enlarged Group on the role of food safety issues.
