A Study On The Construction Of Legal Management System Of Modern Enterprise

Legal counsel is a relative new career in China,since this new career was created more than thirty years ago,it realize rapid development alone with the fast growing economic.Now it has a considerable scale and enters a senior development stage.Nevertheless,domestic management basic theory and management theory construction of legal counsel are still very weak compare with oversea legal counsel.How to research,conclude legal management theory and construct legal management theory system of modern enterprises,is a main issue for those enterprise manager and legal counsel.Based on the summary author's work experience and reference of other legal management theory,this paper summarizes a relative reasonable legal management theory.Following this theory,this paper elaborates several specific management measures and actions and provides beneficial reference for others legal counsel.This paper comprise three parts,first part brief the develop history of legal counsel and legal management basic conception,object and significance of study.The second part introduce legal management module of domestic and international enterprises.Point out that domestic legal management still lack of management theory even though legal management has experienced quite a long time development and practice.This part also introduces legal management development of oversea enterprises,in the end,guide and summarize author's legal management theory of modern enterprises.The third part describes the construction of legal management system of modern enterprises in four parts,which including compliance management,risk management,competitive advantage and operating management,each part is elaborated with practical experience.In the last part of this paper,author points out that modern enterprise raise higher request of legal counsel which may demand legal counsel breach the limitation of traditional legal affairs,ie.breach major,broaden vision,form legal counsel's own special management theory,and construct legal management system of modern enterprise accordingly.
