Studies On Life Imprisonment

Life imprisonment originated in the Western countries,was first put forward as a substitute for the death penalty.The legislation of most Western countries prescribes life imprisonment as an independent punishment,with a strong severity.Life imprisonment is based on the retribution punishment theory and objective punishment theory,in the realization of the retribution to the criminals,but also to achieve the purpose of prevention.In the "Ninth Criminal Law Amendment" the first time introduced life imprisonment.This is the product of the dual pressure of caution with death penalty and high pressure of anti-corruption.Life imprisonment into the penalty,on the one hand can effectively combat corruption and bribery crimes,on the other hand it can limit and reduce the application of the death penalty.This article discusses the birth and development of life imprisonment,the status quo of legislation,the legislative basis and the comparison between life imprisonment and our country's life imprisonment,and make a systematic introduction to life imprisonment.Based on the provisions of the current "Ninth Criminal Law Amendment" in China,the author puts forward some suggestions for the perfection of life imprisonment.The article is divided into four parts:the first chapter introduces the life imprisonment from the aspects of the birth and development of life imprisonment,the present situation of legislation and so on.The second chapter overview of life imprisonment,this chapter introduces the concept and classification of life imprisonment,the theoretical basis of life imprisonment,and the dispute over the abolition of life imprisonment.The third chapter analyzes the legislative status quo of life imprisonment in China's "Ninth Criminal Law Amendment".The fourth chapter systematically discusses the similarities and differences between life imprisonment and life imprisonment in China,and draws the conclusion that the life imprisonment in China should be replaced by life imprisonment.
