Study On Legal Issues Of Labor Standards Incorporated In China-Foreign Trade Agreements

Economic development and living standard arise along with steady intensification of economic globalization and rapid development of trade liberalization.However,many contradictions have derived from infinite yearning to maximize interests in trade competition,and some social issues that have a close relationship with international trade are increasingly becoming the focus of international society,such as labor standards.Since the time of economic globalization,developed countries have repeatedly raised the issue of labor standards on the grounds of human rights,and highly linked it with international trade,but the linkage has been through a long process and in gridlock for several times.After interruption of linking labor standards with multilateral trade agreements,a new situation has been opened up by combining labor standards with regional trade agreements,which has been followed worldwide.In Dec.2016,TPP comprehensively regulates labor standards in a special chapter on a high standard.Labor standards provisions under newly-reached TPP provides the Party's labor laws being directly related to fundamental rights stated under the International Labor Organization(ILO)Declaration on Fundamental Principles and Rights at Work and its Follow-up(1998)?and applied to its export processing zones.Considering the failure of linking with multilateral trade agreements but success in regional or bilateral agreements,this study is a systematical legal research on issues of labor standards incorporated in China trade agreements.This essay includes introduction,text and conclusion.Introduction discusses research background,literature review,innovation and deficiency.With the trend of economic globalization,labor issues have not been a country 's problem anymore,but increasingly crossed boundaries in the process of linkage with trade and gradually been recognized by regional trade.To China,it means that issues of labor standards cannot be avoided in signing future trade agreements.Therefore,the significance of this essay is to figure out how to improve our current labor protection regulations to shorten the distance to international labor standards,and how to make labor standards be incorporated in future trade agreements.Text can be divided into three parts.The first part discusses the framework of labor standards from historical background of formation to final setting.The second part discusses several main trends of trade-linked labor standards,analyzes design of the framework of each trend,states the process of labor standards being multilateral trade-linked to regional or bilateral trade-linked,and selectively analyzes the latest legal issues of labor standards under TPP.This essay concludes that each trend of labor standards doesn't stand alone,with the former affecting the latter and in turn being improved.At last,based on the framework of TPP,this essay discusses the gap between our current labor protection regulations and international ones,and the status quo and deficiency of labor standards incorporated in China trade agreements,with legal countermeasures forwarded.Conclusion highly summarizes the whole essay.
