The Discussion About What Role The Chairman Of Our Country Plays And Where It Positions In Constitution

The chairman of the State is the representative of the People's Republic of China(P.R.C)and one of the national institutions.It is nearly 70 years that China's current state chair system has experienced a process from the text to practice,practice to convention,the virtual right to the real right,and the virtual right to return to the real power of the development process from the founding of the P.R.C to the present.We can forecast that this will not only be the future development trend of our country chair system,but also the performance of the constitutional system conforms to the domestic political change request and the international communication background.Although the study of the state chair system has never stopped,there are not many literatures on the series of related issues such as text,practice,government structure,system perfection and so on.Besides,the extraterritorial analysis of the chairman system is fewer.Based on this situation,I will be from the legal text to the political practice to sort out the development process of the state chair system from the founding of the beginning to the present text.And then through the empirical methods to analyze and interpret it which including longitudinal comparison of the powers of the state president,and the interaction between horizontal and other relevant national institutions,and the comparison of similar institutions and government structures in other democracies,thus forming a more comprehensive discussion of the presidential system in this paper.The first chapter of this paper is the use of normative research method and the main study of the legal text of the national chair system.This chapter analyzes the relevant provisions of the state chair system in several constitutional texts since the founding of the People's Republic of China,mainly focusing on the functions and powers of the President,the term of office the vice-chairman's arrangement and so on.The second chapter mainly analyzes the relationship between the political participation and the exercise of the functions of the state chairmen in their participation in political practice,and how they relate to their status within the ruling party.And in the case where the text and practice of the constitutional system of the President of the State show real tension,constitutional practice becomes a mediator.The third chapter is based on the comparative field of view to analyze the role of political structure of the government of different countries and their heads of state in the government structure.The Constitution is a declaration of civil rights,which restrains strong state power.The President of the People's Republic of China is elected by the National People's Congress,which is beyond the power of the House of Representatives,and as the Head of State,it has the highest national symbol.To set up a powerful power of the President for the Constitution of the Republic,and regard it as the guardian of the Constitution and the country's vault stone,let the country on behalf of the overall will to supervise the powerful national machinery,and then by the civil rights and people's sovereignty to supervise the President to form a complete system of constitutional system.In this process' the important role of the President is also self-evident.
