Study On Personal Information Protection In The Era Of Big Data

Big data era,information become the key factors of production,there is no global exchange of information,there is no global business smoothly.Freedom of information is not only the cornerstone of democracy,also is the foundation of market economy.Personal information as an important social resources,the free flow of personal information is also the inevitable trend of future development.However,the free flow of personal information has inherent contradiction with the personal information protection,to some extent,the traditional views emphasized the protection of the privacy of individual rights,but neglected the social demand for the free flow of information.Keep a balance is the key point of this paper which attempts to explore and discuss.Chapter 1 is the introduction of big data and personal information.Including:the new opportunities and challenges faced in the era of big data,the definition and basic theory of personal information.Chapter 2 is the theoretical basis of personal information protection.This chapter first analyzes and criticizes the traditional privacy protection theory,which is purely based on the protection of human dignity,Then analyzes the personal information protection also have a target of the protection of freedom of information,and summarizes how to achieve a balance.Chapter 3 is the study of comparative law of personal information protection.This chapter mainly comparative study of European,American legal system,that is,the "unified legislative model" represented by European and "dispersed legislative model" represented by American.Through specific elaboration and analysis,the author found that the different value selection leads to different legislative model selection of personal information protection.Chapter 4 is the thinking of perfecting the mechanism of personal information protection in China.On the basis of analyzing the preceding,in combination with the current status of personal information protection in our country,and the author listed some thoughts on the protection of personal information,in order to have some useful influence to the construction of personal information protection of our country in the future.
