Research On Property Right In Big Data Transaction

With the development of computer technology,we have entered the era of big data.Big data will have a transformative impact on human social life and business development.In order to conform to the development of the times,China has promulgated relevant policy documents to promote the development of big data industry,and has established dozens of big data trading platforms to promote the circulation and transaction of big data resources.However,through the investigation of legal policy and practice,it is found that the development of big data industry in China is still in the initial stage,and the big data transaction is under the great risks of property right in the absence of relevant legal policies.In this paper,the big data products in the market are widely used as the research object.Firstly,the relevant theories of property rights in large data transactions are expounded.Then,based on the investigation of the legal policy and practice status of property rights in big data transactions at home and abroad,the paper analyzes the issues such as the legitimacy of authorization,transaction security,transaction cost,fair trade and privacy protection in the process of big data transaction.Thirdly,from the macroscopic point of view,it summarizes the existing problems of the property right mechanism in the big data transaction in China,and put forward the objectives and principles to solve the problems.Finally,on the basis of the above research,this paper puts forward detailed feasibility suggestions for the establishment of property policy,the establishment of industry regulations and the improvement of property rights environment in China's big data transaction.
