The Study Of Tort Liability Caused By Friendship Behavior

China is a traditional country,traditional culture has a long history.Generous,helping others is the behavior of traditional culture support and encouragement.However,today,the helpful,giving others,which caused more and more disputes,the"good" behavior has a certain reflection in present society,so that the social become indifference.This paper called "good" behavior as "Friendship behavior",this name is not put forward first by author,"Friendship behavior" was put forward by dieter Germany at first.The "good" behavior is not adjusted by law,but law will get involved in it if it trigger the damage.In this paper,out of consider for friendship behavior that caused frequent disputes,to explore this behavior,how to define this behavior,which will guidance others to "do good”in our society.At present,the research for friendship behavior is not very much,and judicial practice also lack of unified standard,so the author choose "friendship behavior caused the tort liability",using the limited resources on the depth analysis and discussion,through the analysis of the different academic point of view,their own conclusions,in order to bring to academic research significance.A good paper will define the object that it will discuss.in this paper,starting from the definition and characteristics of bond behavior,by comparison with other legal act and fact act,it is concluded that the nature of friendship behavior.Through the study of the classification of friendship behavior to illustrate the important point of this paper is pure friendship behavior.The last part is discussing friendship tort constitutive requirements and responsibility undertakes the way that caused by friendship behavior.Through the friendship behavior and the cause of tort liability,to clarify the friendship behavior does not belong to the legal behavior,but if slightly do not pay attention to,will enter legal adjustment range.Due to the limited space and data,the study of this paper haven't discuss many important points,I hope you understand.
