Concept of the word "friendship behavior" is derived from the German civil law,the applicable law in the western countries have more mature,about friendship behavior legislation is blank in our country,the academic circle of friendship action research is not thorough,the tort liability for the feelings of the determination and did not form a unified opinion,caused a great trouble to the judicial practice.As a judge,the author has deeply realized in the process of hearing the cases of friendship act infringement that different courts have different or even different judgments on similar cases,which not only affects the impartiality and authority of justice,but also goes against guiding people to engage in social activities.In view of this,the author on the basis of the existing theoretical research,the paper summarizes knowledge and deep thinking,in case introduction and analysis as the guide,put forward the research legal issues,the importance of friendship behavior by discussing feelings towards the basic concept of the infringement behavior,friendship,friendship behavior tort imputation principle,constitutive requirements and legal responsibility,put forward to perfect our friendship behavior tort liability disputes solution,makes every effort to provide valuable reference for the judicial practice.
