On Criminal Identification System

In criminal justice activities,identification are generally identified as an effective way of investigation and are widely used in the investigation of criminal facts.However,through a large number of wrong cases at home and abroad,identification is easily to become the wrong means to conviction.In the course of the analysis of the typical cases of China,the author finds that not following the procedure,and the large numbers of disturbing factors haven't been scientifically and rationally analyzed.Torture and so on,this is the status of criminal identification in our country.This paper analyzes thereasons for the accuracy of criminal identification,describes the current situation of criminal identification in China,and finally puts forward some aspects of how to establish and perfect the concept of criminal identification system in our country.The first chapter is the concept of criminal identification.Before solving the problem,this chapter first explores the concept of criminal identification.This paper puts forward the understanding of the concept of criminal recognition by introducing some views on the identification of academic circles in our country and combining with the recognition of Anglo-American countries.In addition,this chapter also summarizes some of the characteristics of criminal identification by comparing several categories of criminal identification.The second chapter analyzes the causes of the accuracy of criminal identification.This chapter explores the reasons for the accuracy of criminal identification from five aspects.First of all,from the perspective of "human boundless rationality",through the Marxist epistemology and Hayek "evolutionary rationalism" theory shows that the objective existence of human rationality of the limitations.This shows that people in the cognitive and expression will inevitably be biased,or even wrong.Secondly,from the psychological point of view,people in information acquisition,storage,extraction of the objective impact of the existence of the identification of factors,as well as the individual expression of the differences should be considered in the need to review the conclusions.And then from the identification of the human himself,identify the object,identify the environment,respectively,discuss which factors can affect the accuracy of criminal identification.Chapter 3:Status of China's Criminal Identification System.First of all,from the legislative point of view,illustrates the current lack of criminal identification system in China.Secondly,through the analysis of the five wrong cases,it reveals the non-scientific and irrational status quo of the absence of legislation in the judicial practice and the identification of the procedure,and summarizes some rules and examinations to identify the conclusions.And chapter 3 has laid some practical basis and discusses on how to improve and establish our country's criminal identification system.The fourth chapter is the perfection of our country's criminal identification system.Respectively,from establishing the regulation of criminal identification,improve the procedures of criminal identification and improve the criminal identification of the review mechanism.This paper puts forward some rules of procedure before and after the establishment of recognition,as well as the rules of review,the rules of evidence supplementation,and so on.
