Research On The National Staff In The State-funded Enterprises

The economic system reform under the wave of the state-owned enterprise restructuring and countries to encourage,support and guide the policy of non-public economy forward.these makes types of companies in our country is no longer confined to state-owned enterprises or companies,then the state-owned holding enterprises,the state-owned share companies and other types of state-funded enterprises.The Enterprise State-owned Assets Law put into force from May 1,2009 says State-funded enterprises including the state-owned enterprises or companies,the state-owned holding enterprises and the state joint-stock companies.in this paper,it is discussed in this scope.The abstractness of the legislation and judicial practice of the complexity of the decision on this issue must be doctrine.Although with is the state functionaries in State-funded enterprises,but the national staff and non-state staff s corruption exists,is completely different,the death penalty is the highest,and the latter up to 15 years in prison.Only from the point of view of the vast difference between the punishment,great importance to the research has the problem.On the cognizance of this problem is not only about the boundaries of the crime and another crime.more about the cognizance of the crime and not a crime.this article is divided into five parts,from the existing legislative and judicial interpretation and the theory of controversy,in order to clarify the scope of national staff in State-funded enterprises,and the analysis of the current problem about the cognizance,finally to clarify my point of view.
